911 Caller With Gun in Home Invasion

Indiana, November 17, 2007, Woman protects herself during home invasion when police could not get to her home in time.

Some listeners have noted the shots are difficult to hear in this call. There are several reasons. The final shot is hard to hear because the gun was pressed against the attacker, turning the attacker's body into a highly effective suppressor. Also, the recording is naturally picking up layers of distortion over the phone system. Further, the sounds of the door being kicked confuse matters.

To help clarify, Bergner states at 5:33, "What are you trying to do, kill me?", which we know was after some of the shots were fired. The wounded intruder (Bergner) tries to strangle the woman. At 5:43, you can faintly hear the final shot, which is suppressed as explained above. The woman then experiences overwhelming shock, as the struggle with the attacker is over.

To the woman in this audio, I have the highest regard for you and hope that you will not mind us using your story to illustrate the need for responsible gun ownership.

Obama, Holder Push to Loosen Gun Sale Restrictions—for Legal Immigrants

While the shooting at Connecticut’s Sandy Hook Elementary School has prompted a national gun control debate, President Barack Obama and Attorney General Eric Holder will still push to allow immigrants to purchase firearms more easily.

Normally, the Department of Justice’s Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) requires legal aliens to live in a state for 90 days before buying a gun. The ATF does this through a rule attached to the Gun Control Act of 1968.

In June, Holder’s DOJ proposed to eliminate that 90-day residency requirement rule.

“This rule would finalize the interim final rule published on June 7, 2012 by removing the 90-day State residency requirement for aliens lawfully present in the United States to purchase or acquire a firearm,” the proposal to eliminate that requirement reads in part. “The Department has determined that the Gun Control Act does not permit ATF to impose a regulatory requirement that aliens lawfully present in the United States are subject to a 90-day State residency requirement when such a requirement is not applicable to U.S. citizens.”

The move to allow aliens easier access to firearms is now in its final stages.

In Defense of the Second Amendment

I want to go over in considerable detail the fundamental issues of the Second Amendment to the United States Constitution: the right to keep and bear arms.

There is a great deal of emotional commitment in the United States to one of two extreme positions: (1) the right of every non-felon adult citizen of the United States to own any weapon he chooses, and (2) the right of the government of the United States to outlaw the ownership of firearms.

I am hard core. I would extend this right to convicted felons who have served their time or have made restitution to their victims. I would not let the federal government revoke this fundamental right of citizenship.

To understand the Second Amendment, we need to go back to something like the beginning.

Liberals Panic As They Lose the Gun Narrative

When you argue for a living, you can tell how an argument is going for you. The evidence and my gut both tell me that the liberals have lost control of the gun control narrative.

Not for lack of trying – it was almost as if they were poised to leap into action across the political, media and cultural spectrum the second the next semi-human creep shot up another “gun free zone.” This was their big opening to shift the debate and now it’s closing. They’ve lost, and they are going nuts.

The evidence is all around that this is not going to be the moment where America begins a slide into disarmed submission through an endless series of ever-harsher “reasonable restrictions” on our fundamental rights. You just have to look past the shrieking media harpies to see what’s really happening.

Let’s start with the most obvious omen that this tsunami has peaked. President Obama thrilled his base by grandstanding at the memorial, and then promptly washed his hands of it by handing it over to a “blue ribbon commission.” Making Joe Biden its chairman was like staking a vampire through the heart, then hosing him down with holy water before burying his body beneath the Gilroy Garlic Festival.

Why does Obama want this gun thing buried? While intensely popular with metrosexual pundits, coastal liberals, and cultural bigots slobbering at the opportunity to stick it to those banjo –strummin’, God-believers out in the hinterlands, gun control remains poison to Red State Democrats.

Summary of 2013 legislation

Following is a summary of the 2013 legislation:

* Bans the sale, transfer, importation, or manufacturing of:
o 120 specifically-named firearms
o Certain other semiautomatic rifles, handguns, shotguns that can accept a detachable magazine and have one military characteristic
o Semiautomatic rifles and handguns with a fixed magazine that can accept more than 10 rounds
* Strengthens the 1994 Assault Weapons Ban and various state bans by:
o Moving from a 2-characteristic test to a 1-characteristic test
o Eliminating the easy-to-remove bayonet mounts and flash suppressors from the characteristics test
o Banning firearms with “thumbhole stocks” and “bullet buttons” to address attempts to “work around” prior bans
* Bans large-capacity ammunition feeding devices capable of accepting more than 10 rounds.
* Protects legitimate hunters and the rights of existing gun owners by:
o Grandfathering weapons legally possessed on the date of enactment
o Exempting over 900 specifically-named weapons used for hunting or sporting purposes and
o Exempting antique, manually-operated, and permanently disabled weapons
* Requires that grandfathered weapons be registered under the National Firearms Act, to include:
o Background check of owner and any transferee;
o Type and serial number of the firearm;
o Positive identification, including photograph and fingerprint;
o Certification from local law enforcement of identity and that possession would not violate State or local law; and
o Dedicated funding for ATF to implement registration

Record number of Americans oppose handgun ban

An unprecedented number of Americans support the right to own a handgun, despite the recent mass killings at an elementary school in Newtown, Conn., that have renewed the push for gun control.

Even with the killings in Newtown as a backdrop, a new Gallup poll shows 74 percent of Americans now support the right to possess a handgun, while just 24 percent would support a ban.
